Broadcom Patent Win Over Emulex

A federal appeals court affirmed a district court’s finding that Emulex Corp. infringed a patent held by Broadcom Corp. related to data sampling.

The appeals court also affirmed the lower court’s determination that the patent would not have been obvious at the time of invention, and hence invalid, and affirmed that the lower court properly exercised its discretion in granting a permanent injunction in the case.
